Mission: To protect the health, safety and welfare of the general public by regulating and controlling the liquor industry in the importation, manufacture, sale and service of alcoholic beverages.

Program Description:
The Department of Liquor Control is responsible for the regulation and control of the importation, manufacture, sale and service of alcoholic beverages by providing services in liquor license and permit applications, licensees' education, site inspections, and enforcement of liquor laws and rules.

Department Goals:
 


  • To enforce the Hawaii Revised Statutes and the Rules of the Liquor Commission, County of Maui.
     


  • To promote liquor control through alcohol education and to achieve voluntary compliance with liquor laws and rules by licensees.
     


  • To control the conditions associated with the importation, manufacture, sale and service of alcoholic beverages through a fair and efficient licensing and permit process.
     



  • To provide the necessary staff and services to the Liquor Commission and Liquor Control Adjudication Board to carry out their responsibilities as set forth within the Hawaii Revised Statutes and the Charter of the County of Maui.

    Liquor Commission
    Charter Section 8-13.2. The liquor control commission shall consist of nine members appointed by the mayor with the approval of the council. The liquor control commission shall:

     
      1. Prepare and submit a request for an annual appropriation for the operation of the department.
      2. Adopt rules having the force and effect of law for the administration of liquor control in the County and to carry out provisions of the liquor control laws of the State, including, but not limited to, the fixing of liquor license fees.
      3. Grant, renew or refuse applications for licenses for the manufacture, importation and sale of liquor in the County under applicable laws and regulations.
      4. Have such other powers and duties as may be provided by law not in conflict with the provisions of this section.

    All meetings are held on the second Wednesday of each month commencing at 9:00 A.M. (Except in June & July 2008) (Additional meeting to be held in March 2008)


    Liquor Control Adjudication Board
    The liquor control adjudication board shall consist of nine members appointed by the mayor with the approval of the council. The liquor control adjudication board shall hear and determine administrative complaints of the director regarding violations of the liquor control laws of the State or of rules of the liquor control commission, and impose penalties for violations thereof as may be provided by law.

    Certification Exam
    On every licensed premises, an on-duty employee duly approved by the director who is 21 years of age or older, has successfully completed an examination administered by the department on liquor laws and rules of the Commission and attended a server training program, must be in active charge of each premises during all times that such premises is open for business.

    All certificates shall be valid for four years from the date of issue.

    Certificates must be renewed by re-examination.

        a. Good for all classes (1 through 14) of Liquor License
      2. Retail (40 Questions)
        a. Good only in Class 4, Retail Dealers License
      3. Wholesale (40 Questions)
        a. Good only in Class 3, Wholesale Dealers License

    Registration on a first come, first served basis between:

    Exam starts promptly at:

    9:30 am
    Upon passing the exam, $10.00 will be collected for your certification card fee.    
    A mandatory education session will conclude at approximately:
    11:30am
    12:00 noon

    Minor Registration
    No person under twenty-one years of age shall be employed in any section of a licensed premises where liquor is sold, stored, served, consumed or readily accessible or available unless the minor has registered with the Department of Liquor Control and obtained approval from the director for the employment of, or the entertainment by, such minor.

    Procedure:
      1. Minor must obtain a Department of Liquor Control Registration of Minor for Employment (or Entertainment) Form from their employer approving such minor to be employed.
    Register, in person with the Department of Liquor Control (submit the Registration of Minor for Employment or Registration of Minor for Entertainment).

      2. Minors 18-20 years of age:
    Registration must be completed by 3:00 p.m.

    Minors under 18 years of age:
    Minor must schedule an interview with an investigator -
    (Wailuku 243-7753 or Lahaina 661-9581).

    Minor must be accompanied by a parent of legal guardian for the interview.
    Registration must be completed by 3:00 p.m.

    Permits
    Permits are required, but not limited to the following:
      1. Outside warehousing and storage areas;
      2. Individual permit for importation of liquor;
      3. Trade shows;
      4. Installation of any game device;
      5. Reduction or increase of licensed premises;
      6. Area(s) for music, entertainment, and dancing;
      7. Fashion shows or beauty pageants;
      8. Product tasting;
      9.

    Modification to licensed premises other than what was submitted to and approved by the commission at the time of application.

    Procedure
      1. Obtain an Application for Permit and instruction sheet from the Department of Liquor Control.
      2. Follow the instruction sheet for the particular type of permit you are applying for.
      3. Submit the Application for Permit to the Department of Liquor Control.
     
    Liquor License Application
    Application for a liquor license must be filed with the Department on a form prescribed by the Commission in accordance with the Rules of the Liquor Commission. The Department will not accept any application that is not complete, neat or legible. All portions of the application shall be completed. N/A or not applicable shall be entered on any portion of the application.

    Applicant shall meet with a liquor control officer of the Administrative Services Division by appointment. Please call (808) 243-7030 (Wailuku) or 661-9581 (Lahaina) for an appointment.

    Special License
    A special license may be granted by the Director for the sale of liquor. Special licenses shall be issued only to charitable or educational not-for-profit organizations, to political parties and to candidate seeking public office. Not-for-profit charitable or educational organizations are required to provide their U.S. Internal Revenue's section 501(c)(3) at the time of filing their Application for Special Liquor License.

    Caterer License
    A caterer license may be granted to any class 2, restaurant license, or class 12, hotel license, that sells food prepared and cooked within its Department of Health and Department of Fire Control approved kitchen facilities and served for consumption by patrons within its premises and who serves food as part of their operation for the sale of liquor while performing food catering functions.

    Catering service for the sale of liquor off the licensee's premises may be granted in accordance with the Rules of the Liquor Commission.

    Direct Shipments of Wine
    Due to changes in the Hawaii Revised Statutes, Chapter 281, Reciprocal Shipments of Wine, has been repealed and a new section entitled Direct Shipments of Wine which is quoted below, will become effective January 1, 2007. Reciprocal shipments of wine permits issued by this department will expire as of midnight December 31, 2006.

    HAWAII REVISED STATUTES
    “§281- 33.6 Direct shipment of wine by wineries.

       Any person holding:
       
    a.
           A general excise tax license from the department of taxation; and

    b.
           Either:

     
    i. A class 1 license to manufacture wine under section 281-31; or

     
    ii. A license to manufacture wine issued by another state, may pay any applicable fees and obtain a direct wine shipper permit from the liquor commission of the county to which the wine will be shipped authorizing the holder to directly ship wine to persons in the county pursuant to this section.

        The holder of a direct wine shipper permit may sell and annually ship to any person twenty-one years of age or older in the county that issued the permit, no more than six nine-liter cases of wine per household for personal use only and not for resale, and shall:

       
    c.
        Ship wine directly to the person only in containers that are conspicuously labeled with the words:

      "CONTAINS ALCOHOL: SIGNATURE OF PERSON AGE 21 YEARS OR OLDER REQUIRED FOR DELIVERY.";

    d.
      Require that the carrier of the shipment obtain the signature of any person twenty-one years of age or older before delivering the shipment;

    e.
      Report no later than January 31 of each year to the liquor commission in each county where a direct wine shipper permit is held, the total amount of wine shipped to persons in the county during the preceding calendar year;

    f.
      Pay all applicable general excise and gallonage taxes. For gallonage tax purposes, all wine sold under a direct wine shipper permit shall be deemed to be wine sold in the state; and

    g.
      Be subject to audit by the liquor commission of each county in which a permit is held.

        The holder of a license to manufacture wine issued by another state may annually renew a direct wine shipper permit by providing the liquor commission that issued the permit with a copy of the license and paying all required fees. The holder of a class 1 license to manufacture wine under section 281-31 may renew a direct wine shipper permit concurrently with the class 1 license by complying with all applicable laws and paying all required fees.

    The sale and shipment of wine directly to a person in this state by a person that does not possess a valid direct wine shipper permit is prohibited. Knowingly violating this law is a misdemeanor.

    The liquor commissions in each county may adopt rules and regulations necessary to carry out the intent and purpose of this section."
