Description

Advises and assists the Mayor in all phases of the County's Equal Employment Opportunity (EEO) program, based on federal guidelines and requirements. Also advises and assists the Mayor in reaching the County's affirmative action goals and objectives concerning race, sex, religion, handicap, etc., in employment, and to take affirmative action in correcting past discrimination.

To hear and determine appeals from decisions concerning dangerous dogs as set forth in sections 6.04.045 and 6.04.050, and from any order issued by an enforcement or animal control officer relating thereto.

Hears and determines appeals from the decisions made by the County related to the Building Code, Plumbing Code, Electrical Code and Housing Code, and from any order made by the Fire Chief in the administration of applicable State law (i.e. Chapter 132, HRS) and the Fire Code relating to matters involving the proposed use of new or alternate materials, types of construction, equipment, devices or appliances.

Initiates, receives, hears and investigates complaints of violations of the County Ethics Code by employees and officers of the County. Initiates impeachment proceedings against elected officials and officers appointed to elective office who have been found in violation of the Code of Ethics of the County.

Hears and determines applications for variances from the strict application of any general plan, zoning, subdivision or building ordinances. Holds public hearing prior to ruling on a variance application and issues findings of fact and conclusions of law on decisions granting or denying variance applications.

Advises and assists the Mayor in all matters concerning children & youth, including childcare. Also makes recommendations to the County Council on all matters relating to children and youth and children and youth programs proposed for adoption by the County Council.

Objectives include: assisting the County in the preservation of the artistic and cultural heritages of all its people; promoting a community environment which provides equal and abundant opportunity for exposure to culture and the arts in all its forms; encouraging and providing equal opportunity for the development of cultural and artistic talents of the people of the County.

Prepares a list of the names of all existing streets, parks and facilities for Council. Recommends names for streets, parks or facilities to the Council. Adopts rules and regulations for the conduct of its duties. Advises and assists subdividers who desire to name roads within a subdivision in the County.

Develops information as the State Commission on the Status of Women requires or as the Committee deems advisable concerning the status of women within the County. Submits to the State Commission plans and proposals affecting the status of women in the County.

Helps the County promote economy, efficiency and improved service to the public by reviewing existing County operations and policies and making recommendations to improve them. Submits an annual report of its findings and recommendations to the Mayor and Council.

Reviews and considers matters relating to: (1) the Department of Personel Services, including cost items, and the Department of Finance; (2) the County Budget, capital program, and intergovernmental loans; (3) real property tax rates, water rates, and other rates, fees, and assessments; (4) County bond authorizations, appropriations, and amendments; and (5) audits.

Review and consider matters relating to requests for community plan amendments (except for decennial amendments), State district boundary amendments, zoning, variances, conditional permits, and land use approvals.

Council is specifically empowered to: (1) legislate taxes, rates, fees, assessments and special assessments, and to borrow money, subject to the limitations provided by law and the Charter of the County of Maui; (2) legislate appropriations for County purposes subject to the limitations provided by the Charter of the County of Maui; (3) conduct investigations of (a) the operation of any department or function of the County and (b) any subject upon which the Council may legislate; (4) fix the salaries of appointed Legislative employees and officers as may be necessary; (5) require periodic and special reports from all County departments concerning their functions and operations; and (6) retain or employ, by a vote of two-thirds of its entire membership, special counsel (private attorneys) for any special matter presenting a real necessity for such employment.

Review and consider matters relating to: (1) the Department of Planning, except for matters within the purview of the Land Use Committee; and the Department of Transportation, including mass transit; (2) amendments to the general plan and decennial amendments to the community plans; (3) the creation and revision of the County’s long-range and master plans not within the purview of another standing committee, including those relating to shoreline management, beach management, mountains, and bikeways; (4) environmental protection, including recycling; and (5) the Energy Management Program, conservation, and energy efficiency.

Review and consider matters relating to: (1) the Office of the Mayor and the Department of Management, except for the Management Information Systems Division and the Energy Management Program; the Department of the Corporation Counsel; the Department of Fire Control and Public Safety; the Department of Housing and Human Concerns; the Department of Liquor Control; the Department of Police; the Department of the Prosecuting Attorney; and the Civil Defense Agency; (2) the operations of the legislative branch; (3) special counsel, indemnifications, and settlements; (4) appointments of board and commission members, Corporation Counsel, Prosecuting Attorney, Director of Water Supply, and any other positions for which Council approval is required; (5) affordable housing, including applications under Chapter 201H of the Hawaii Revised Statutes; (6) intergovernmental matters, including the County Legislative Package; the Hawaii Association of Counties (HSAC), including the HSAC Legislative Package; and the National Association of Counties; and (7) general policy that are not substantially within the exclusive purview of another standing committee, as determined by the Council.

Review and consider matters relating to: (1) the Department of Public Works and the Department of Environmental Management, except those matters relating to environmental protection; the Department of Parks and Recreation and related concessions; and the Office of Economic Development; (2) cultural, leisure, sporting, athletic, and other recreational activities; (3) traffic management and the traffic code; (4) naming of streets and facilities; and (5) economic development, agriculture, and technology, including the Management Information Systems Division and the County’s Geographic Information Systems.

Review and consider matters relating to: (1) the Department of Water Supply; and (2) the State Commission on Water Resource Management and compliance with safe drinking water rules and regulations.

Meets at least every other month for the purpose of advising the County Executive Office on Aging on needs of older persons, plans for helping older persons, programs that service older persons, and legislation and issues affecting older persons. The Council also advocates for the needs of older persons, and plans and coordinates the Maui County Senior Citizens Fair.

Reviews applications for new development and renovation projects in the Wailuku Redevelopment Area authorized by Section 53-5 of the Hawai`i Revised Statutes pertaining to the Urban Renewal Law.
