Public testimony will be taken at the start of the meeting on any agenda item in order to accommodate those individuals who cannot be present at the meeting when the agenda item(s) is (are) considered by the Maui Planning Commission. Public testimony will also be taken when the agenda item is taken up by the Maui Planning Commission. Maximum time limits on individual testimony may be established by the Planning Commission. A person testifying at the beginning of the meeting will not be allowed to testify again when the agenda item comes up before the Commission, unless new or additional information will be offered.

D. COMMUNICATIONS



1. NB LOT 3, LLC (formerly KAANAPALI DEVELOPMENT CORP.) requesting review and comments of the August 2003 Update to the Design Guidelines for the Kaanapali North Beach Subdivision (previously approved by the Maui Planning Commission in December 1996) pursuant to Condition gg. of the Special Management Area Use Permit for the Kaanapali Ocean Resort located on Lot 1 of the Subdivision. (J. Alueta)



Condition no. gg. of the 1998 Kaanapali Ocean Resort SMA Permit states that the applicant shall present to the Maui Planning Commission updates to the design guidelines together with the Kaanapali North Beach master plan for review and comment after conducting a community based planning program. The declarant has previously presented to the Maui Planning Commission the results of its community based planning program, Kaanapali 2020: Making It Pono for review and comment. The lands involved included the Kaanapali North Beach Subdivision.



The Kaanapali North Beach Subdivision is an approximately 96-acre extension of the Kaanapali Beach Resort lying northwest of Kai Ala Drive between Honoapiilani Highway, Lower Honoapiilani Road, and the Pacific Ocean.
